Terms of Service
The RadioThat data deal
Your taste is yours. We use your listening and voting only to run your stations and make the crowd's radio better. We never sell your data, never share it for advertising, and never build advertising profiles of you. What the crowd loves — in aggregate, never as individuals — shapes what gets made next. Delete your account and your personal data goes with it; your anonymous votes remain part of the station's history. Full detail lives in the Privacy Policy.
These Terms of Service (the Terms) form a binding agreement between you and RadioThat (we, us, our) covering your access to and use of the RadioThat website, apps, and services (together, the Service). This page is maintained by the RadioThat team as app-owned editable content, not an independent certification. By creating an account or listening to any station, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and your account
You must be at least 13 years old to use RadioThat, and old enough in your country to form a binding contract. If you are under the age of majority where you live, you may only use the Service with the involvement of a parent or legal guardian. You are responsible for everything that happens under your account, for keeping your login credentials confidential, and for notifying us promptly if you suspect unauthorized use. One person per account; you may not share, sell, or transfer your account.
Free accounts include unlimited listening, six skips per hour, up to three stations, and a vote weight of one. Premium accounts include unlimited skips, unlimited stations, a vote weight of two, and the Tastemaker badge. Feature limits, pool sizes, and skip rules may change; we will not materially reduce a paid Premium benefit for the current billing period without notice.
2. License to use the Service
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own non-commercial listening. All rights not expressly granted are reserved.
3. The music — AI-original tracks
Every track on RadioThat is generated by our automated music pipeline and shared across the entire community. The tracks, their audio files, titles, cover art, and metadata are owned or licensed by RadioThat. You receive only the limited streaming license described above.
You may not, and may not permit anyone else to:
- download, record, rip, cache offline, or otherwise copy the audio outside normal in-app playback;
- redistribute, publicly perform, broadcast, or make the audio available to third parties;
- remix, sample, sync to video, or create derivative works from any track;
- use any track (in whole or in part) in commercial productions, advertising, or monetized content;
- claim authorship of, or misrepresent the origin of, any track; or
- strip, hide, or alter the "AI-original" attribution or any other RadioThat mark.
Sharing a station. RadioThat lets you share a station with others through an in-app share link (for example, a /s/… URL). Sharing a station conveys only the same limited, personal, non-commercial streaming license described above to the person who opens the link — it does not grant them, or you, any right to download, re-host, embed, redistribute, broadcast, sync, remix, or monetize the audio, the cover art, or any track metadata. The share link is a pointer to playback on RadioThat; the tracks continue to stream from RadioThat and remain owned or licensed by us. We may disable, rate-limit, expire, or revoke any share link at any time, and share links must not be used to bypass account limits, tier features, geographic restrictions, or any other rule in these Terms.
Tracks may be promoted, retired, or removed by community feedback and our lifecycle systems at any time; we do not guarantee that any specific track will remain available.
4. Voting and community conduct
RadioThat is tuned by the crowd. To keep the signal honest:
- one vote per listener per track, changeable at any time;
- votes are only counted after you have heard at least thirty seconds of that track in your current session;
- votes are rate-limited (currently sixty per user per hour);
- community scores are computed on our servers using a Wilson lower-bound calculation and are informational in the app.
Vote manipulation, bots, scripts, coordinated brigading, multi-account voting, buying or selling votes, or any attempt to game ranking or generation are strictly prohibited and are grounds for immediate suspension or termination and forfeiture of any prepaid amounts, without refund.
5. Acceptable use
You agree not to:
- use the Service for any unlawful, infringing, harassing, or harmful purpose;
- attempt to reverse engineer, decompile, scrape, or extract source code, models, prompts, or non-public data from the Service;
- probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure, except through our published security-contact process;
- interfere with, overload, or disrupt the Service or the servers or networks that support it;
- use the Service to train, fine-tune, or benchmark any machine-learning model, or to build a competing service;
- impersonate any person or entity, or misrepresent your affiliation with anyone;
- upload viruses, malware, or other harmful code, or use the Service to send unsolicited communications.
Voice control. Voice control is off by default. If you turn it on in your profile, holding the mic button records short audio clips from your device and sends them to our AI transcription provider so we can convert them into player commands. Use it only for your own voice and normal player commands, keep the microphone away from other people who have not agreed to be recorded, and do not try to use voice input to bypass skip limits, vote weighting, or other rules of the Service. 6. Feedback and submissions
If you send us feedback, suggestions, bug reports, or ideas about the Service, you grant RadioThat a perpetual, worldwide, royalty-free, sublicensable license to use that feedback for any purpose, without obligation to you.
7. Subscriptions, billing, and refunds
Premium currently costs $4.99 per month (or $39/year), billed in advance by our payment processor, Stripe. Prices are shown at checkout and may be updated for future billing periods; we will give you reasonable notice before any price change takes effect.
Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your profile and will keep Premium features through the end of the current period. Except where required by law, payments are non-refundable and we do not provide credit or refunds for partial periods, unused time, or downgrade. Taxes, if any, are your responsibility. If a payment fails, we may downgrade your account to Free until the balance is settled.
8. Intellectual property; copyright complaints
RadioThat, the RadioThat name and logo, the mono mark, the amber-to-coral gradient, the "Radio that ___" lockup, the Kilo mascot, the site design, and all other content we provide are owned by RadioThat or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.
If you believe content on RadioThat infringes your copyright, send a notice under the U.S. Digital Millennium Copyright Act (DMCA) to legal@radiothat.com that includes: (a) an electronic or physical signature; (b) identification of the copyrighted work; (c) identification of the material claimed to be infringing and its location on the Service; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. We may remove content and terminate repeat infringers in appropriate circumstances.
9. Third-party services
The Service integrates with third parties, including Stripe for payments and Google for optional sign-in. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY SPECIFIC TRACK, GENRE, POOL, OR FEATURE WILL BE AVAILABLE AT ANY GIVEN TIME. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RADIOTHAT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
12. Indemnification
You agree to defend, indemnify, and hold harmless RadioThat and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any law or third-party right.
13. Suspension and termination
You may close your account at any time from your profile or by writing to us. We may suspend, restrict, or terminate your account and access to the Service, with or without notice, if you violate these Terms, if we are required to do so by law, or if we reasonably believe your use puts the Service, its listeners, or its music library at risk. Sections that by their nature should survive termination will survive, including sections 3, 5–6, and 8–15.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You and RadioThat agree to first attempt to resolve any dispute informally by contacting legal@radiothat.com. If we cannot resolve it within sixty days, either party may bring an individual action in the state or federal courts located in Delaware, and both parties consent to their exclusive jurisdiction and venue. You and RadioThat waive any right to a jury trial and to participate in a class or representative action to the extent permitted by law.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date above and give reasonable notice through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.
